What is the Potential Value of My Case?

Unfortunately, it’s impossible to provide you with a magic number on a webpage like this. That’s because there are many factors that go into determining the value of your case.

Some of these factors include:

  • Medical costs. Did you make a trip to the ER? Were you admitted to the hospital? Did you need surgery? How about follow-up care?
  • Job impact. If you work, we’ll want to understand more how your injury impacted your ability to work. For instance, if you missed significant time off work or missed out on overtime or bonus opportunities.
  • Pain and suffering. These are considered non-economic damages, and they generally do factor into your potential settlement amount.
  • Sources of funds. Simply put, we need to identify the at-fault party and their ability to pay. Often, settlements come from insurance carriers, so the policy types and limits can play a big factor.
  • Jury or judge. In most cases, we’re able to settle outside of court. However, there are times when we feel negotiations aren’t going in our client’s favor and we may file a lawsuit.
  • Past verdicts. We can use verdicts of past, similar cases to help give us an idea of what may be fair for your situation.

Should we choose to work together, we will keep you apprised of the potential value of your case as it progresses.

What are the Advantages of Working with a Personal Injury Attorney?

To be sure, you can file a personal injury claim without a lawyer. But if you’ve been serious harmed, we recommend that at the very least, you give us a call to discuss your options first.

At Ladenburg Law, we know how to bring together the right kinds of evidence to build your case. As we’ve been through this process many times over, we have ideas, resources, and insights to navigate even the most complex claims. Furthermore, if we find that we’re unable to negotiate a fair settlement, we’ll be prepared to argue your case before a jury or judge.

Make sure to see what past clients have had to say about working with our lawyers.

How long do I have to file a claim in Washington State?

In general, you have three years from your injury to file a claim (see RCW 4.16.080 for the nitty gritty). However, there are a few exceptions to this case including if we’re dealing with a victim under the age of 18 or a malpractice victim where the injury was discovered much later.

No matter what, we recommend that you involve a personal injury attorney as soon as possible after an injury. There are a few reasons we make this suggestion. First, it gives the attorney access evidence while it’s still fresh. Second, you receive the most thorough legal assistance possible. And finally and most important, it increases your chances of winning the best possible settlement.
