Here are a few questions to ask yourself:

  1. Was someone else obligated to keep me safe? For instance, a doctor is obligated to “do no harm.” Other drivers on the road are obligated to abide by traffic laws. A property owner is obligated to keep their premises safe or to warn you of known hazards.
  2. Did that person fail in their duty? In other words, we should be able to prove that the other party behaved in a negligent or careless way. (Please note, there are some exceptions to this question.)

  4. Did the injury result in damages? Simply put, “damages” refer to medical expenses, lost wages, pain, and suffering you experienced because of your injury. Some injuries are minor and may not result in damages substantial enough to warrant a personal injury claim.
