What should I do after my car accident? 

Here are the steps we recommend taking after a car accident:

  1. Remain calm and assess injuries. Take a deep breath and try to remain calm. If there are any serious or life-threatening injuries, call 911.
  2. Call the police if there is significant damage or injuries. Alert the police for help.
  3. Gather information. Exchange contact and insurance information with the other driver. If applicable, get witness names and numbers.
  4. Take photos (your phone camera works). Take pictures of the scene, the other car, your car, any injuries, skid marks, traffic stops, and weather conditions.
  5. Seek medical care. If you’re injured, you need to see a doctor as soon as possible – ideally, the same day.
  6. Open a claim with your insurance company. Alert the insurance company you’ll be opening a claim. You can do this on your own or with the help of a personal injury attorney. Do this quickly; there is no harm in opening a claim.

One final note: while you should talk to the other driver to exchange information, avoid discussing who was at fault. Simple statements, such as “I’m sorry,” made in the heat of the moment, may be used against you later.

The insurance company keeps calling – what do I do?

To be clear, you should alert the insurance company (either yours or the other driver’s) of the accident. It’s important that a claim gets opened as soon as possible.

However, we tell our clients to not provide a recorded statement to the other driver’s insurance company. The representatives may seem friendly and even concerned about your injuries. But, remember that their job is to reduce their losses. That means they’ll work hard to find ways to discredit your claim. Bottom line: nothing good can come from providing a recorded statement.

Besides this, be wary of your phone interactions with insurance representatives. Avoid answering questions about how you’re feeling or the extent of your injuries. Tell them that your attorney will be in touch. (And if you end up hiring one of our attorneys, we’ll make sure these phone calls end altogether.)

What can I do if the other driver didn’t have insurance? 

Even though the law requires drivers carry insurance, it’s estimated that 20% of Washington drivers do not.

If you are the unfortunate victim of one of these drivers, it’s possible that you can file a claim under your own policy. Review your policy or ask your agent if you have uninsured motorists’ coverage. We can assist in these situations, too.
